1. Scope and Contracting Parties

1.1 Provider

1.2 Target Audience (B2B Restriction)

The "Paketshop Manager" App is intended exclusively for businesses/entrepreneurs.

The App is not intended for consumers. By registering and using the App, you confirm that you are a business/entrepreneur and use the App exclusively for business purposes.

1.3 Scope

These Terms apply to all contracts between the Provider and the User regarding the use of the App.

2. Service Description

2.1 App Features

• Recording and management of parcels in a parcel shop
• Automatic recognition of parcel carrier and recipient name (OCR technology)
• Management of storage locations and retention periods
• Local storage of all data on the customer's device

2.2 Pricing

All prices include statutory VAT.

2.3 Free Trial Period

New customers receive a one-time, free trial period of 30 days. After expiry of the trial period, the subscription is automatically converted into a paid subscription, unless you cancel before the expiry of the trial period.

3. Contract Conclusion and Subscription

3.1 Contract Conclusion

The contract is concluded when the customer downloads the App from the Apple App Store or Google Play Store and accepts the terms of use.

3.2 Payment Processing

Payment processing is carried out exclusively via Apple or Google.

3.3 Automatic Renewal

Subscriptions are automatically renewed unless cancelled at least 24 hours before the end of the term.

3.4 Cancellation

Cancellation is made directly via the subscription management of the Apple App Store or Google Play Store. No proportional refund is granted in the event of early cancellation.

4. Customer Obligations

4.1 Personal Responsibility

• Ensuring the confidentiality of stored data
• Regular backup of data
• Ensuring that only authorized employees have access
• Compliance with the requirements of logistics contract partners

4.2 Data Protection

When using the App, the customer processes personal data of parcel recipients and is responsible for this within the meaning of the GDPR.

4.3 Prohibited Use

• Use for non-commercial purposes
• Sharing access data with unauthorized third parties
• Manipulation or reverse engineering of the App
• Circumvention of tier restrictions

5. Rights of Use

Upon contract conclusion, the customer receives a simple, non-exclusive, non-transferable right of use for the duration of the subscription.

6. Liability

6.1 Limitation of Liability

• Unlimited for intent and gross negligence
• For simple negligence only in the event of breach of essential contractual obligations, limited to the typical foreseeable damage

6.2 Exclusion of Liability for Data Loss

The Provider is not liable for:

• Data loss due to device defects
• Data loss due to improper use or uninstallation
• Consequential damages from incorrect recognition of parcel information

6.3 OCR Recognition

The Provider does not guarantee 100% recognition accuracy. The customer is obliged to check all recognized data.

7. Warranty (B2B)

Shortened inspection and notification obligations apply, as well as a shortened warranty period of 12 months.

8. Data Protection

The processing of personal data takes place in accordance with our Privacy Policy.

9. Contract Changes

We reserve the right to change these Terms. Changes will be communicated at least 30 days before they take effect. If the customer does not object within 30 days, the changed Terms are deemed accepted.

10. Final Provisions

Irish law applies. Exclusive place of jurisdiction is Dublin, Ireland.
